1. Liability Release (Signature Required)

I am aware that the Advanced Yoga Program is here to serve me by sharing knowledge of Kundalini Yoga (in Yogi Bhajan’s Tradition and the mother Traditions). I recognize that yoga requires physical exertion that may be strenuous and may cause physical injury, and I am fully aware of the risks and hazards involved. I understand that it is my responsibility to consult with a physician prior to and regarding my participation in the Program. I represent and warrant that I am physically fit and I have no medical condition that would prevent my full participation in the Program.

Universal Tree and the Mystical Travels with a Yogi team reserve the right to dismiss hostile participants solely on their discretion and evaluation of each traveler’s cooperation.

In consideration of being permitted to participate in the Program, I agree to assume full responsibility for any risks, injuries or damages, known or unknown, which I might incur as a result of participating in the Program.

I agree to indemnify and hold harmless the Program; Mystical Travels with a Yogi, Universal Tree, Yogi Amandeep Singh and any affiliations and/or subordinate corporations not stated herein, their officers, directors, employees, agents, or volunteer staff from and against all claims, actions, demands, proceedings, liabilities, cost and expenses, including reasonable attorney’s fees, which they may have ascertained against or incurred by them arising as a result of my participation in the Program. I understand that I must complete all the requirements.

I further agree to allow Universal Tree/Mystical Travels with a Yogi to use photographs and video recordings of me taken during the Program to be used for promotional materials and products. The participant cannot record this course by any method.

I understand that this yatra in an adventure in a foreign country whereas all risks, liabilities, and potential hazards are not the responsibility of the Program, its organizers, or affiliates. Mystical Travels with a Yogi has the rights to change the location of the travels due to unseen circumstances.

I, my heirs or legal representatives forever release, waive, discharge and covenant not to sue or make any claims of any kind whatsoever against the Program or any of the aforementioned parties for any injury, property damage/loss, or death caused by their negligence or other acts.

2. Arbitration Agreement (Signature Required)

This Agreement is made between Universal Tree / Yogi Amandeep, hereinafter referred to as "First Party" and Yatra Participant

WHEREAS, the relationship between the parties commenced ____________ (Enter today’s date) as defined in the original

contract, namely Mystical Travels Yatra 2023 Himalayas;

AND WHEREAS the parties herein recognize disputes and differences may arise between the parties;

AND WHEREAS the parties recognize that litigation in court can be time consuming and expensive;

AND WHEREAS the parties agree it is in their best interest to appoint an arbitrator to resolve such disputes as they arise;

NOW IT IS AGREED BETWEEN THE PARTIES HERETO AS FOLLOWS:

The parties hereto agree to refer the following matters and responsibilities to the Arbitrator:

Second Party acknowledge that his / her own behavior may be risky while traveling with a group in a foreign country. Second Party acknowledges that he / she will be held fully responsible for his / her person, belongings, safety, and emotional / psychological condition. First Party is not obligate to provide special security measures or Duty of Care beyond the delivery of yoga program and travel itinerary. If Party Two is in any way dissatisfied with accommodations, travel conditions, or the behavior of local people, or any other situations that are reasonably beyond First Party’s control, Second Party releases First Party from all liabilities, responsibilities, charges, and obligations.

If disputes must resort to arbitration, the Arbitrator shall listen to facts from both parties. Guide parties to a peaceful resolution of dispute. Ensure that Universal Tree / Yogi Amandeep will not be held liable for damages, physical, financial, emotional, or otherwise. Ensure that Universal Tree / Yogi Amandeep will not suffer cruel and unfair libel, slander, harassment, or defamation.

In the event there are any disputes or controversies that arise between the parties pursuant to the terms of the aforesaid Contract, then the parties are waiving their right to litigate these issues in court and instead elect to have these disputes resolved through arbitration.

The parties agree that any disputes are to be arbitrated through the American Arbitration Association and that the parties agree to abide by the rules of the Commercial Arbitration Rules of the American Arbitration Association.

WHEREFORE, it is agreed that all claims and disputes arising or relating to the Contract are to be settled by binding arbitration in the State of California. Said arbitration is to be resolved through the Commercial Arbitration Rules of the American Arbitration Association and the parties agree to abide by these rules.

Any decision or award as a result of any such arbitration shall be issued in writing and the arbitrator shall be mutually selected pursuant to the Commercial Arbitration Rules of the American Arbitration Association.

Any arbitration award may be confirmed in a court of competent jurisdiction.

Please send us a copy of additional travel medical insurance (this is mandatory for all applicants who are not Indian citizens applying for the Yatra). This form must be received before March 1, 2023.

In consideration of me being allowed to participate in activities sponsored by Mystical Travels with a Yogi, Universal Tree, I do hereby release, forever discharge, and agree to hold harmless Universal Tree, Mystical Travels with a Yogi and it’s volunteers, employees, directors, members, agents, staff, trip sponsors, vehicle owners, and vehicle drivers from any and all liability, claims, or demands for personal injury, sickness, or death, as well as property damage, including theft and expenses, of any nature whatsoever which may be incurred by participating in an activity sponsored by Mystical Travels with a Yogi, Universal Tree. I understand that many of the activities will be physical in nature, may include travel and I hereby assume all risk of personal injury, sickness, death, damage, and expenses as a result of participation in all activities involved therein.

I further hereby agree to hold harmless and indemnify Mystical Travels with a Yogii, Universal Tree and its volunteers, employees, officers, directors, members, agents, staff, trip sponsors, vehicle owners, and vehicle drivers for any liability sustained by said organizations as the result of the negligent, willful or intentional acts of said participant, including expenses incurred attendant thereto.

I hereby grant my permission to be taken to a doctor or hospital and hereby authorize medical treatment, including, but not in limitation to

emergency surgery or medical treatment, and I assume the responsibility of all medical bills, if any.
